1. Who we are

This website at 1291supply.ch and the store operating under the name “1291 Supply Co.” (the “Store”, “we”, “us”, “our”) is an independent, privately operated Swiss online store selling print-on-demand merchandise — including embroidered caps, t-shirts, hoodies, mugs, tote bags, stickers and aprons — carrying the design theme “Switzerland – Great Since 1291”.

The Store is operated by Overclock GmbH, Blegistrasse 11a, 6340 Baar, Zug, Switzerland. You can reach us at hello@1291supply.ch. Full operator details are set out in our Imprint / Impressum.

2. Merchant of record & how a sale works

The Store operates on the e-commerce and fulfilment platform provided by Fourthwall, Inc. (“Fourthwall”). This is important, so please read it carefully:

Fourthwall is the merchant of record On every transaction placed through this Store, Fourthwall acts as the merchant of record. That means Fourthwall is legally the seller of the product to you, is the counterparty on your purchase contract, processes your payment, and calculates, collects and remits all applicable sales tax and VAT (using Avalara AvaTax). We, the Store operator, create and curate the designs, set prices, and provide customer support — but the commercial sale, payment processing, tax handling and order fulfilment are carried out through Fourthwall as merchant of record.

By placing an order, you acknowledge that your purchase is concluded with Fourthwall as merchant of record and that Fourthwall’s own terms of service and applicable policies also apply to the transaction, payment and fulfilment. Where these Terms and Fourthwall’s terms both apply, they are intended to operate together; where they genuinely conflict on the mechanics of payment, tax or fulfilment, Fourthwall’s terms govern that specific mechanic.

3. Acceptance of these terms

These Terms & Conditions (the “Terms”) govern your access to and use of this website and any order you place through it. By browsing the Store, adding items to your cart, or completing a purchase, you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy, our Shipping Policy and our Returns & Refunds Policy, each of which is incorporated by reference.

4. Eligibility

You may place an order only if you are at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding contract. If you are ordering on behalf of a business or another person, you confirm you are authorised to do so.

5. Products & product descriptions

All items are made to order (print-on-demand). Because each item is individually printed or embroidered:

We aim to describe products accurately, but we do not warrant that descriptions or other content are error-free. If a product you received is materially not as described, see section 11.

6. Orders & contract formation

Displaying products on the Store is an invitation to treat, not a binding offer. When you complete checkout you make an offer to purchase. The purchase contract is formed when your order is accepted and confirmed — typically evidenced by an order-confirmation email issued via Fourthwall.

We (and Fourthwall as merchant of record) may decline or cancel an order in whole or in part — for example where an item is unavailable, where there is an obvious pricing or description error, where payment is not authorised, or where we reasonably suspect fraud or a breach of these Terms. If we cancel an order you have already paid for, you will receive a full refund of the amount charged for the cancelled items.

7. Prices, taxes & VAT

Prices are shown in the currency indicated at checkout and are exclusive of shipping unless otherwise stated. Shipping charges (if any) are calculated and displayed before you confirm your order.

Tax & VAT are handled by Fourthwall As merchant of record, Fourthwall calculates, collects and remits all applicable sales tax and VAT via Avalara AvaTax. Any tax due is shown at checkout before you pay. Depending on your delivery destination and order value, additional import taxes or customs clearance charges may apply on delivery — see section 10 and our Shipping Policy.

8. Payment

Payment is processed securely by Fourthwall and its third-party payment processors (such as Stripe and PayPal). We do not receive or store your full card details. Your payment method is charged at the time your order is accepted. All accepted payment methods are shown at checkout.

9. Production, fulfilment & delivery

Items are produced on demand by Fourthwall’s global production partners (located in the US, UK and EU) and shipped to you, including within Switzerland and internationally. Indicative production time is approximately 2–7 business days before an order ships (embroidered caps may take a little longer); delivery time then varies by destination and carrier. Full details are in our Shipping Policy. Stated timeframes are estimates, not guarantees.

10. Import duties & customs

For cross-border deliveries, the recipient is the importer of record for customs purposes. As merchant of record, Fourthwall handles sales tax and VAT calculated at checkout; however, depending on destination and order value, the carrier may collect import VAT and/or a small customs clearance fee on delivery. For deliveries to Switzerland, low-value single items generally arrive without additional import charges, while larger orders or bundles may incur Swiss import VAT plus a carrier clearance fee. We disclose this honestly in our Shipping Policy. Any such charges are your responsibility.

11. Custom-made goods, defects & returns

Custom-made means no buyer’s-remorse returns Because every item is individually produced to order for you, there is no general right of withdrawal or buyer’s-remorse return for these personalised/made-to-order goods. This reflects the standard exemption for customised goods under EU distance-selling rules, and Swiss law does not provide a statutory cooling-off period for most online purchases. We cannot accept returns simply because you changed your mind.

That said, we stand behind our products. If your item arrives defective, damaged, misprinted, or is the wrong item, we will provide a free replacement or a refund, provided you contact us with a clear photo within 14 days of delivery. Because items are made to order, we cannot accept general or size-related returns or exchanges — please check the size guide before ordering. Full steps are in our Returns & Refunds Policy. Nothing in this section limits your mandatory statutory rights as a consumer.

12. Intellectual property in our designs

The phrase “Switzerland – Great Since 1291”, the “1291 Supply Co.” name and logo, and all artwork, graphics, layouts and designs on this Store are independent and original works created by or for us, and are protected by copyright and other intellectual-property rights. All rights are reserved.

You may not copy, reproduce, resell, redistribute, or create derivative works from our designs or content without our prior written permission. Purchasing an item grants you ownership of that physical item for personal use only; it does not transfer any rights in the underlying design.

13. Non-affiliation & parody disclaimer

Independent, unofficial & not government-affiliated 1291 Supply Co. is an independent store. Our designs are self-aware, culturally-referential apparel. We are NOT affiliated with, endorsed by, sponsored by, or connected to Guy Parmelin, the Swiss Federal Council, Präsenz Schweiz / Presence Switzerland, the Swiss Confederation, or any government body, agency or official. We do not use any individual’s name, image, likeness, portrait or signature. The Swiss coat of arms is not used. A decorative Swiss-cross motif and the word “Switzerland” are used purely stylistically and do not imply official status or government endorsement; they also do not indicate the products’ country of origin. The goods are manufactured to order outside Switzerland, and we make no “Swiss made” or Swiss-origin claim. All original artwork remains our own and our rights in it are reserved.

14. Acceptable use

You agree not to use the Store unlawfully; not to interfere with its operation or security; not to scrape, copy or misappropriate its content; and not to submit false, misleading or fraudulent information. We may suspend or terminate access for breach of these Terms.

15. Warranty & conformity

Products are supplied with the statutory guarantee of conformity that applies to your purchase. To the fullest extent permitted by law, and without limiting your mandatory consumer rights, all other warranties, representations and conditions — whether express or implied — are excluded. Our remedy commitments for defective, damaged, misprinted or wrong items are set out in section 11 and the Returns & Refunds Policy.

16. Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability arising out of or in connection with any order is limited to the price you paid for the affected products. We are not liable for indirect, incidental, consequential or special losses, or for loss of profit, data or goodwill. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud, or for any mandatory consumer-protection rights.

Because Fourthwall is the merchant of record, payment processor and fulfilment provider, certain matters (payment, tax collection, production and shipping) are performed by Fourthwall and its partners, and are subject to their terms and liability arrangements.

17. Force majeure

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, war, strikes, carrier or supplier failures, customs delays, outages or governmental measures.

18. Privacy

We process personal data in accordance with our Privacy Policy, which explains what we collect, why, the legal bases, the processors involved (including Fourthwall, payment processors and Avalara), international transfers, retention and your rights under the revised Swiss Federal Act on Data Protection (revFADP) and the EU GDPR.

19. Changes to these terms

We may update these Terms from time to time. The version in force is the one published on this page at the time you place your order, shown by the “Last updated” date above. Material changes do not apply retroactively to orders already placed.

20. Severability & entire agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in full effect, and the invalid provision will be replaced by a valid one that most closely reflects its intent. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and us regarding the Store.

21. Governing law & jurisdiction

These Terms and any dispute arising from them or from your use of the Store are governed by the substantive laws of Switzerland, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zug, Switzerland. This choice of law and forum does not deprive you, as a consumer, of the protection of the mandatory consumer-protection provisions of the law of your country of residence.
